MARKHAM, ONT – A lawyer involved in a high profile copyright lawsuit filed by the Aga Khan was taken into custody by York Regional Police and charged with assault with a weapon after he allegedly hurled a heavy ceramic plate loaded with food at a man at the Unionville Ismaili Mosque located in Markham.
Alnaz Jiwa was released from custody following the laying of the single charge of assault with a weapon and acceptance of several conditions which prohibit him from approaching the victim or being at the same mosque pending disposition of the matter by a judge.
A date for appearance was not disclosed by police in Markham when Vancouverite contacted York Regional Police.
Police confirmed to Vancouverite last night that a “consensual” verbal argument led to a suspect hurling a plate at the forehead of an Ismaili worshipper who was about to leave the mosque.
A police spokesman said the victim suffered injuries to the forehead area. The policeman also said several cruisers were sent to the mosque on Apple Creek Boulevard to take witness statements.
He said the undertakings obtained from the suspect, who is a Toronto lawyer, were in line with making sure there was no further harm to the victim or a future disturbance at the place of worship.
Jiwa and another defendant, Nagib Tajdin, have been involved in a high profile legal battle with the Aga Khan who sued them for copyright infringement of his pronouncements to his followers. The Federal Court of Canada is currently considering a summary judgment verdict asked for by both sides.
Witnesses told Vancouverite that the victim was left bleeding from the forehead from the assault.
“The plate narrowly missed the victim’s eye,” said one witness who saw the aftermath of the incident. “There were pieces of the plate and food all over the carpet.”
The witness said Jiwa allegedly hurtled the plate as the other person was making his way out of the prayer hall accompanied by his family. There had earlier been a verbal exchange between Jiwa and the victim, according to the witness.
Several people who witnessed the assault gave police statements about the altercation, a source said and police confirmed.

my take on this whole issue is Alnaz is being tortured day after day by jamat and jamati members......why would somebody hurl a saucer at someone for no reason !!

A few points to ponder--- Alnaz has / was under a lot of pressure lately... for one of the jamati members to provoke him is considered an emotional assault.... why jamati members have to confront or say anything to Alnaz whenever they see him ?
If Mowla himself has handled and directed this matter to be dealt differently who are these jamati members to approach Alnaz whenever he is seen no matter what)
A lot of jamati members misuse their authority--- they never think carefully before pronouncing or acting.... remember that you as an individual do not have a right on someone else (especially even if "you" think they are at fault etc.) Fear the Lord; say and act with care, we being ismailies and having Hazar Imam (unlike other communities) who do not have a Hazar (present living Imam) MUST HAVE AN EVEN GREATER RESPONSIBILITY TO USE AUTHORITY AND ACT CAREFULLY. IT IS SAID THE LORD'S SERVANTS MUST NOT QUARREL BUT MUST BE KIND TO EVERYONE, NO MATTER WHAT, THEY MUST BE ABLE TO TEACH EFFECTIVELY AND BE PATIENT WITH DIFFICULT PEOPLE..... THEY SHOULD GENTLY TEACH THOSE WHO OPPOSE THE TRUTH.
This applies also those volunteering..... PLEASE PLEASE DO NOT USE YOUR SEWA TO ABUSE SOMEONE ELSE just because YOU have a problem wtih them !! Be very careful.... there is no point in doing sewa if you misuse and abuse the opportunity..... you want to pass your time and are lonely..... don't do it in khane in the form of sewa that eventually leads you to be commiting these emotional CRIMES to people !!
I have heard of people using abusive and filthy languages inside J.K. towards others for no real reason, and these very people are (happen to be) in sewa..... as volunteers who do nandi, carry darbaris and darbari fruits.... this is really a shame and very very SAD ..... because these very people do not deserve these kind of sewas....... and MUST NOT BE DOING SO. They have to be stopped.... from touching these pious items.

It seems now there is a growing concern that Alnaz should not have defended himself. Perhaps those who say that he shouldn't have, should try and put themselves in Alnaz's shoes.
From what I hear, Alnaz is a very quiet peaceful person. He goes to many J.K's and it was only at this J.K where M.Kamadia and his gang were verbally bullying him whilst he was standing in the Dua Karavi line, that this altercation took place. Apparently they were taunting Alnaz to leave the J.K,, pushing him and telling him they will "break his batrisi". Alnaz said, if you want to break my batrisi, lets go outside. They didn't go outside. Then again, after nandi was over, Alnaz was provoked again by the chamcho of the gang, punched at least 3 times on the shoulder, and it was then that Alnaz took the swing and left a mark on chamcho showing that he was not going to be intimidated by anyone anymore. The leader of the gang (M.Kamadia)who was standing right behind Alnaz then ran and called the police but he was not man-enough to face Alnaz one-on-one ! This is what I was told by those who were present when this incident took place.
Sad as it may be, this incident is an eye-opener for the leadership to wake up and be true to the oath that they have taken. Perhaps now local leadership will realize that they too have an obligation to fulfill their responsibilities as per the Constitution and not follow the higher leaders blindly.

Alnaz was attacked when he was leaving Unionville Jamatkhana in Toronto with a Nandi in his hand this week.
The same gang attacked me in Ottawa, Sparks Street where there are CCTV surveillance cameras because of the Court. That was 12 October 2010. Police report was filed.
There is also the component of previous threats and hate emails on me and Alnaz. IP number of originating threats have been traced and remitted to the authorities. I believe by now the names of the people logged on that IP when these messages were posted, have been found. I have to be in Canada for the matter to proceed further but for now I am in Nairobi. Obviously authorities know where to look in case something happens to me or to Alnaz.
When the inquiry ends, all these events will be joined and criminals will be punished according to Canadian laws.
